Terms of Service

In short: you own your stories and are responsible for them; we host them and show them to the readers you share them with. Paid plans renew until you cancel. Payments are handled by our reseller, Paddle. Don't publish anything you don't have the right to publish.

1. Who we are

Burning Tree Press is operated by Keith B. Phillips ("we", "us"). You can reach us at hello@burningtreepress.com. These terms form an agreement between you and us when you create an account or publish with Burning Tree Press (the "Service").

3. Your stories and your rights

You keep all ownership rights in the text, images, and other material you upload ("your content"). To run the Service, you give us a worldwide, non-exclusive, royalty-free license to store, copy, format, and display your content, and to make it available at the links we create for it, only for as long as it remains on the Service. This license ends when you delete the content, except for copies kept in routine backups for a limited time.

You confirm that you own your content or have permission to publish it, and that publishing it doesn't break the law or our Content Policy.

4. How sharing works

Each published story gets an unlisted link that is hard to guess. We don't list your stories in a directory. However, anyone who has the link can read the story and share it further, and a reader can save it to their device. Don't publish anything you need to keep confidential.

6. If your plan ends

If a paid subscription ends, stories you've already published stay online at the same links. You can continue to edit one story on the Free plan; the rest become read-only until you subscribe again. You can unpublish or delete any of your stories at any time.

7. Fair use

The Service is built for writers sharing their work. To keep it fast for everyone, plans include reasonable limits (for example, on the number of stories, uploads, and publishes per day). We may limit or pause activity that puts unusual strain on the Service, and we'll contact you first where we reasonably can.

8. Things you agree not to do

Don't use the Service to break the law or our Content Policy; to distribute malware or phishing; to try to access other people's accounts or our systems without permission; or to resell the Service without our written agreement.

9. Removing content and closing accounts

We may remove content or suspend an account that we reasonably believe breaks these terms or the law, or that puts readers or the Service at risk. Where appropriate, we'll tell you why and give you a chance to respond. You can close your account at any time; we'll delete your stories and account data as described in our Privacy Policy.

10. Copyright complaints

If you believe a story on the Service infringes your copyright, email hello@burningtreepress.com with the link to the story, a description of your work, your contact details, and a statement that you have a good-faith belief the use isn't authorized. We'll review it promptly and may remove the content.

11. Availability and changes to the Service

We work hard to keep the Service and your readers' links available, but we can't promise it will always be uninterrupted or error-free. Please keep your own copy of your manuscripts. We may improve or change features over time. If we ever shut down the Service, we'll give paying writers at least 60 days' notice and a way to download their stories.

12. Disclaimers and limitation of liability

The Service is provided "as is". To the extent the law allows, we disclaim implied warranties, and our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

13. Changes to these terms

We may update these terms. If a change materially affects you, we'll email you or show a notice in the app at least 14 days before it takes effect. If you keep using the Service after that, the updated terms apply.

14. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where the law of your home country requires otherwise.
